HOUSTON -- A Texas appeals court panel has upheld a lower court's order that the state's prison agency must identify its execution drug supplier. The ruling Thursday from the 3rd Court of Appeals is in response to a lawsuit and has limited impact. State lawyers argued such a disclosure could expose the supplier to physical harm. Prison agency spokesman Jason Clark says the decision will be appealed to the Texas Supreme Court. Prison officials declined to name the source, saying they came from a licensed compounding pharmacy in Texas.

Prison officials declined to name the source, saying only that execution drugs were purchased from a licensed compounding pharmacy in Texas. A state appeals court ruled Thursday that Texas prison officials must identify the pharmacy that supplies the state with drugs used in executions. Fearing backlash, prison officials do not want to disclose the source of the state's execution drugs. The ruling will be appealed to the Texas Supreme Court, said Jason Clark, spokesman for the Texas Department of Criminal Justice. But writing for the appeals court's three-judge panel, Justice Bob Pemberton said prison officials could point to no more than isolated, vague threats against suppliers of execution drugs.
